Getting Started on Your Divorce in Texas

Qualifying for a Simple Texas Divorce

Before you can apply and get started on your case, please be aware of the requirements for filing in Texas.

To qualify for a divorce in Texas:

  • Either you or your spouse must have lived in Texas for at least six months. As long as one spouse still lives in Texas, you can file your divorce in Texas.
  • You must have lived in your county for 90 days before you can file in that county. For example, if you and your spouse lived in Collin County and you have moved to Denton County, you can only file in Denton County if you have resided there for 90 days (three months).

If you meet the residency requirements, then in order to qualify for one of our Simple Texas Divorce programs:

  • Your spouse must agree to waive service of citation. If your spouse does not agree, he or she will need to be served with process. Your case does not qualify for a Simple Texas Divorce.
  • You must be able to locate your spouse. If you are not able to locate your spouse, your spouse cannot agree to a Waiver of Service. Your case does not qualify for a Simple Texas Divorce.
    • What if I cannot locate my spouse? Simple Texas Divorce is a program for couples who are agreed, meaning, your spouse is willing to sign any and all paperwork required for you to get a divorce in the State of Texas.   • Both you and your spouse must want a divorce. While Texas allows for one spouse to file a divorce despite the wishes of the other, it makes for a more complicated process.
  • You and your spouse must agree on division of property, child visitation, and child support. Disagreement lengthens the process and no longer makes it simple and quick.
